Welcome to homeeddiary.com. By accessing or using our website, homeeddiary.com (the "Site"), you (the "User") agree to comply with and be bound by the following terms and conditions (the "Terms"). Please read the Terms carefully before using our services. If you do not agree to the Terms, you should not use our website or services.
1. Acceptance of Terms
- By accessing or using the Site, you agree to be bound by the Terms and any other policies or guidelines posted on the Site. If you do not agree to follow any part of these Terms, you must not use the Site.
2. Services
- The Site allows the User to keep a diary of their home education journey. This information will not be shared with any third party except for essential running of the business (e.g., taking payments, storing data, website hosting). It will be used by us for providing support services, improving and monitoring the Site, and contacting the User when required to provide information about updates to the Site.
3. User Accounts
- The User must create an account to keep a diary, including adding entries and photos.
- The User is responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.
4. Payment and Access
- The User must make timely payments for access to the Site's premium features.
- If a payment is missed, access to the Site's premium features will be suspended.
- We reserve the right to terminate accounts and delete the User's data for non-payment.
5. Data Retention and Deletion
- If the User's account is suspended or terminated for any reason, we will retain their data for a minimum of one month to give the User time to reactivate their payment and account, unless the User subsequently requests their data or account be deleted.
- The User may request the deletion of their account and data at any time by contacting us at [email protected].
- The request for deletion must come from the email address associated with the account on the Site.
- Upon request for account deletion, we will cancel the subscription, and delete all the User's data except for minimal data required for our own financial records. Any remaining credit on the account will not be refunded. The deletion of the User's data will be permanent.
- If the User cancels their subscription, this does not result in an immediate deletion of data, unless a request for data deletion is also made. We reserve the right to delete data at any time if there is no active subscription.
- If the User cancels their subscription, they can continue to use the Site until the billing period end, i.e., end of the month for monthly subscriptions, and end of the year for annual subscriptions.
- If the User has an account left in credit when a subscription is cancelled, no refund will be given.
6. User Content
- The User retains ownership of the photos they upload.
7. Prohibited Conduct
- The User may not upload content that is unlawful, harmful, abusive, defamatory, or otherwise objectionable.
- The User may not use the Site for any illegal or unauthorized purpose.
8. Termination
- We reserve the right to terminate or suspend the User's account at our sole discretion, without notice, for conduct that we believe violates these Terms or is considered harmful to other users of the Site, us, or third parties, or for any other reason. This will result in permanent deletion of the User's data.
9. Disclaimer of Warranties
- The Site and services are provided "as is" and "as available" without any warranties of any kind, either express or implied.
10. Limitation of Liability
- To the fullest extent permitted by law, Home Ed Diary shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- the User's use of or inability to use the Site;
- any unauthorized access to or use of our servers and/or any personal information stored therein;
- any interruption or cessation of transmission to or from the Site;
- any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Site by any third party;
- any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Site;
- the defamatory, offensive, or illegal conduct of any third party.
11. Governing Law
- These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.
12. Changes to Terms
- We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
